Welcome to DropWise Water®, a service offered by Dijital Worlds (“DropWise Water”, “we”, “us”, “our”). These Terms and Conditions of Use (“Terms”) govern your access to and use of the DropWise Water mobile application (“App”).
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE APP.

1. Acceptance of Terms
By downloading or using the App, these Terms will automatically apply to you. Your continued use of the App constitutes your acceptance of these Terms. Please read them carefully before using the App.

2. Eligibility and Age Requirements
– The App is intended for users aged 13 years and older.
– If you are under 18 years of age, you must have permission from a parent or legal guardian to use the App.
– Children under 13 are not authorized to use the service or create an account.

3. License and Usage Rights
3.1 Limited License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and install the App on your personal mobile device and use it for your personal, non-commercial purposes.

– Decompile, disassemble, or attempt to derive source code from the App

– Attempt to gain unauthorized access to any portion of the App
– Use automated systems (bots, scrapers) to access the App
– Sell, resell, rent, or lease access to the App
– Use the App to send spam, unsolicited messages, or inappropriate content
– Collect or harvest any information from other users

4. User Responsibilities
You are responsible for:
– Ensuring your device meets the minimum requirements to run the App
– Maintaining internet connectivity (WiFi or mobile data) when required
– Keeping your device secure and preventing unauthorized access
– Providing accurate information when setting up your profile
– Accepting updates to the App when offered to ensure proper functionality
We recommend NOT jailbreaking or rooting your device, as it could compromise security and prevent the App from functioning correctly.

5. Intellectual Property Rights
The App itself, including all content, features, trademarks, logos, mascot characters, designs, and other intellectual property, belongs to Dijital Worlds. All rights are reserved.
You are NOT permitted to:
– Copy, reproduce, or distribute any part of the App without written consent
– Use our trademarks or branding without authorization
– Create derivative works based on the App

IMPORTANT MEDICAL DISCLAIMER:
– The App is designed for general wellness and hydration tracking purposes ONLY
– The hydration recommendations and goals provided are NOT medical advice

– If you have any health conditions (kidney disease, heart problems, etc.), consult your doctor before using hydration tracking apps
– IF YOU THINK YOU HAVE A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY
We make no guarantees regarding health outcomes from using the App.

7. Third-Party Services
The App uses third-party services that have their own Terms and Conditions:
– Apple HealthKit: For syncing water intake data
– Apple App Store / StoreKit: For processing in-app purchases
– Apple Push Notification Service: For sending reminders
We are not responsible for the actions, products, content, or policies of these third-party services. Please review their respective terms and privacy policies.

8. Subscription and Payment Terms
8.1 Subscription Plans
DropWise Water offers optional premium subscription plans:

8.2 Payment and Billing
– Payment will be charged to your Apple ID Account at confirmation of purchase
– Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
– Your account will be charged for renewal within 24 hours prior to the end of the current period
– Prices are subject to change; any changes will be communicated in advance
8.3 Free Trial
– Free trial subscription automatically converts to a paid subscription unless canceled at least 24 hours before the trial ends
– Any unused portion of a free trial will be forfeited when purchasing a subscription
8.4 Cancellation and Refunds
– No cancellation of the current subscription is allowed during the active subscription period
– To cancel, go to Settings > [Your Name] > Subscriptions in the App Store
– Refund requests must be submitted to Apple through their standard refund process
– We do not process refunds directly; all payments are handled by Apple

10. Disclaimer of Warranties
THE APP AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOU USE THE APP AT YOUR OWN RISK.
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
– Warranties of merchantability
– Fitness for a particular purpose
– Non-infringement of third-party rights
– Accuracy, reliability, or completeness of content
– Uninterrupted or error-free operation
We do not guarantee that the App will meet your requirements or expectations.

11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
– Dijital Worlds will NOT be liable for any indirect, incidental, special, consequential, or punitive damages
– We are NOT liable for any loss of data, health issues, or personal injury arising from App use
– Our total liability shall not exceed the amount you paid for the App (if any) in the past 12 months
– You are solely responsible for maintaining backups of your data

12. Indemnification
You agree to indemnify, defend, and hold harmless Dijital Worlds and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
– Your use or misuse of the App
– Your violation of these Terms
– Your violation of any third-party rights
– Any content you submit through the App

13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. We will notify users of significant changes by:

14. Termination

Upon termination:
